Terms of Use

These conditions govern every visit to Cherokee County Criminal History. Opening a page, reading its content, or using a search feature constitutes agreement to the terms below. Anyone who does not accept them must stop using the website. The restrictions apply to this private reference site as well as to information reached through its links and partner tools.

NO FCRA USE. This privately operated website has no affiliation with a local, Texas, or federal government body. Neither the site nor its advertising partners offers a service for credit decisions, employment screening, insurance underwriting, tenant evaluation, or another purpose governed by the Fair Credit Reporting Act (FCRA). It provides directions to Cherokee County, Texas record resources. It is neither a private investigation firm nor a consumer reporting agency.

1. What This Website Is

This is a private reference site that operates independently of government. It cannot retrieve or store official criminal records, conduct an official check, or file a document for a visitor.

Its pages identify custodians such as the Cherokee County Sheriff's Office, the District and County Clerks in Rusk, the Texas Department of Public Safety (DPS), Crime Records Division, and the Texas Public Sex Offender Registry. Some pages also connect readers to outside research tools.

2. Rules for Using This Site

Every visitor agrees not to:

  • Use bots, scrapers, or other automated tools against these pages
  • Stalk, threaten, or harass another person using information found here
  • Interfere with site performance or prevent another visitor from gaining access
  • Use the site in violation of federal, Texas, or local law
  • Attempt unauthorized access to any system or data
  • Rely on site content for hiring, housing, lending, or insurance decisions

3. No Harassment, Stalking, or Discrimination

No visitor may use information from this website or a linked tool to intimidate, stalk, threaten, harass, or discriminate against anyone. Misuse may also violate the law. Texas Code of Criminal Procedure Article 62.063 specifically prohibits using Texas Public Sex Offender Registry information to injure, harass, or commit a crime. Registry access serves public-safety awareness and does not authorize vigilante conduct, employment blacklisting, or housing discrimination.

4. We Are Not a Consumer Reporting Agency

This site is not a consumer reporting agency under the FCRA and does not produce background checks, credit reports, or any other consumer report. Its advertising partners likewise do not provide site tools designed to evaluate job applicants, rental applications, insurance rates, or creditworthiness. Data from the site or a linked tool may not be used to:

  • Determine eligibility for a license, permit, or government program
  • Set an insurance premium or assess creditworthiness
  • Evaluate a renter or housing applicant
  • Make a hiring or firing decision
  • Carry out any other FCRA-regulated purpose

A lawful check for a regulated purpose must be obtained from an authorized, FCRA-compliant source. Texas DPS official criminal-history channels serve only the purposes and users allowed by governing law.

5. No Legal Advice

Site content is general information, not legal advice. It may describe Cherokee County records and Texas expunction or nondisclosure rules, but it cannot determine how a warrant, charge, conviction, or remedy applies to a particular matter. That assessment requires a licensed Texas attorney.

6. No Warranties

All content and services are supplied "as is." There is no guarantee that:

  • A partner search result will be complete or correct
  • The site will operate continuously without interruption
  • Information is complete, accurate, or current at a given moment
  • Every page is free from bugs, errors, or security weaknesses

Criminal records can change as charges are filed or dismissed and as courts grant nondisclosure or expunction relief. Gaps and delays are unavoidable. No site content is an official statement from a Cherokee County clerk, the Sheriff's Office, Texas DPS, or another government agency.

7. Third-Party Services and Links

Links may lead to sheriff and clerk pages, Texas agency sites, legal-aid organizations, court portals, or outside search services. Those destinations operate beyond this site's control. This site is not responsible for their availability, content, pricing, or data practices, and visitors should review the destination's own terms.

8. Intellectual Property

Text, graphics, logos, and code belong to Cherokee County Criminal History or its content partners. They may not be copied, changed, distributed, or used to create derivative work without prior written permission.

9. Limits on Our Liability

To the broadest extent permitted by law, the site is not liable for damages arising from its use, including reliance on information found here or through a linked service.

10. Indemnification

A visitor agrees to defend and hold the site harmless from a claim, demand, or legal proceeding resulting from that visitor's use of the website or breach of these terms, including related costs and legal fees.

11. Governing Law

Texas law governs these terms. Any dispute connected with use of the website must be brought in a court located in the State of Texas.

12. Changes to These Terms

These terms may be revised at any time. A revised version becomes effective when it is posted on this page.

13. Cutting Off Access

Access to the website may be restricted or terminated at any time, for any reason, without advance notice.

14. Severability

If one provision is held invalid or unenforceable, all remaining provisions continue in effect. The affected provision will be modified only to the minimum extent needed for enforcement.

15. Questions

Questions about these conditions may be directed through the Contact page.
